A Colorado Springs resident will not be charged for fatally shooting an intruder who tried to break into a home that he apparently thought was his, prosecutors said Tuesday.
James Parsons is protected under Colorado’s “Make My Day” law, which allows people to use deadly force in self-defense in their home against intruders, according a statement from the 4th Judicial District Attorney’s Office.
Parsons shot 22-year-old Sean Kennedy, an assistant golf pro at a Colorado Springs golf course, on Dec. 28. Kennedy had been drinking that night and apparently thought he was breaking into his own house, which was a block away.
Aside from the fact that the audio was cut out in several places, one does not typically break glass to get into their own home. Nor usually find strangers in said home, without saying anything, or yelling.
Um, xas? The man was drunk.
And the break-in victims were supposed to know the guy was just drunk and thought he was breaking into his own house? Tragic as it is, the homeowners were justified.
One day you yanks will understand that THIS is exactly why guns have no place in modern society. Tragic….

The *dead* human was guilty of being drunk. The American civilians watch way too many cop shows and are shit scared of anyone. My American colleagues tell me most Americans never see gun violence outside of the TV and movies, they only fear it.

Mike, this is EXACTLY why guns have a place in modern society. yeah, the guy had been drinking, but what he had been wanting the rape the guy’s girlfriend, or thought they were out, so he decided to break into their house. F*** you man, just because your country was raised to be a bunch of ******, doesn’t mean guns are bad.

In Texas they have the castle law…you can shoot anyone in or near your home if they are a threat. this is the way it should be in all states. Maybe people would think twice before committing a crime.

Free people have the right to protect themselves. What’s the alternative? Let people break into your home and do whatever the hell they like with your property or family? Really? If this was a mix up it’s tragic indeed, but I don’t believe everything the news tells us; especially how this newscaster tries to spin it.
FBI crime statistics prove beyond a shadow of a doubt that gun lawful proliferation amongst the population keeps crime at lower levels. I have a CCW and I’ve never had to use it but I hope that when the occasion comes I might have the presence of mind to use it aright.
He “mistaked it as his home” does that not sound like a excuse. How do they know that? It sounds more like “this house looks like mine if I break into it I can say I thought it was mine” is a likely reason.
This reminds me of the English tourist who couldn’t find his way back to his hotel so he knocked on someones front door at 9pm to ask for the directions from the nice friendly yanks. They didn’t open the door, just shot straight through it and killed the poor guy on their doorstep. It could have been anyone, including a cop, a neighbor or a relation of the residents but they blindly opened fire.

I’m wondering how the cops would know that the assailant was “trying to break into his own home”… Did they ask him after he died?
I swear, all these “No guns in modern society” people are going to be the first ones to want the law revoked when someone breaks into their homes and kills somebody. Granted, heavy guns like AK47 and such should be outlawed, THOSE have no place in modern society. Something like a .22 on the other hand would be perfect for DEFENSE. And no, you can’t just shoot anyone that happens to be in your home. If their is no evidence of a break in, its murder. But if someone breaks into my home, I’m going to get the gun and not waste time calling the police, those few second could save lives. If someone has intentions to kill me, I will not hesitate to shoot them. It’s called self defense.

Are you crazy? a .22LR round can kill someone easy enough sure, but not fast enough to stop them killing you 1st if they are armed too.(Little thing called stopping power.)
Heavy guns? “like an AK47.” An AK47 shoots what is basically a small hunting rifle round, and for most civilian owned ones, only in semi-auto, like most of those hunting rifles people use.
Think you can reliably kill a deer with a .22LR?
Or is an AK47 bad due to a plastic/folding stock?
Because “terrorists” use them?
Because a big bad hunting rifle round isn’t needed because we shouldn’t kill deer, or invasive species like wild boar?
Because a bolt-action gun can reliably kill an attacking bear?
Guns don’t kill people, a gun is a tool, and in this case the homeowners acted rightfully and legally.
The only thing they did wrong was having a door that can be broken in via smashing glass in the first place.(well that and only having a .22)
